Terms of service.

Introduction

These Terms & Conditions govern the provision of graphic design services by Weronika Tomaszkiewicz (Tillmar) known with trading name Wera Design Co. (ABN: ) to the Client. By working with Wera Design Co., the Client agrees to comply with and be bound by the following terms.

Services

Wera Design Co. provides branding and graphic design services including, but not limited to: logo design, visual identity systems, social media assets, packaging, websites and brand strategy. All services will be outlined in the agreed project proposal or scope document.

Working Hours

Wera Design Co. operates Monday to Friday, 10 AM - 6 PM (AEST). Weekend or urgent work may be accommodated upon request and will incur additional fees, agreed upon in writing.

Communication

All communication is handled via Notion Project Tracker & Client Portal. Clients must respond to all communication via client portal in a timely manner during the project period. If there is no response for 7 consecutive days, the project will be paused. After 14 days, the project may be cancelled without refund.

Enquiries

All project enquiries must be submitted through the website contact form. Enquiries made via social media will not be accepted.

Contracts & Agreements

All clients are required to sign a Service Agreement before the project begins. This agreement outlines the scope, deliverables, timelines, and payment terms to protect both parties.

Payments

Projects under $1,000 AUD must be paid in full upfront. For projects above $1,000 AUD, a 50/50 split payment is available: 50% deposit due before the project begins, 50% balance due before final delivery of assets. Payment terms are fixed. Missed payments may result in cancellation of the project, and no files will be released until full payment is received. Refunds are not available due to the digital nature of services.

Project Briefs

Clients are responsible for providing a clear and detailed brief. Wera Design Co. does not offer copywriting unless agreed upon. All content submitted must be final. Wera Design Co. is not liable for spelling or grammatical errors provided by the client.

Revisions

Projects include 1 concept and 2 rounds of revisions unless state differently in ‘Service’ page description. Any additional revisions will be charged at $100 AUD/hour, invoiced separately.

Scope Changes

Any additional requests or scope changes outside the agreed proposal will be quoted and billed separately.

File Delivery

Final files will be delivered via WeTransfer and will remain available for 30 days. A $30 AUD fee applies for resending files after this period.

File Retention

Brand packages and large projects: stored for 6 months. Small or one-off projects: stored for 2 weeks after delivery.

Refund Policy

Due to the custom nature of the work, no refunds are offered once the project has begun. All sales are final.

Copyright & Usage

Full ownership and usage rights are granted to the client only after full payment is received. Until then, all rights remain with Wera Design Co., Wera Design Co.retains the right to showcase all work in its portfolio unless otherwise agreed in writing.

Portfolio Use

Completed work may be used in Wera Design Co. portfolio, website, and social media channels. If confidentiality is required, this must be communicated and agreed upon before the project begins.

Conduct

Wera Design Co. maintains a respectful working environment. Rude, abusive, or inappropriate behaviour will not be tolerated and may result in immediate termination of the project without refund.

Liability

Wera Design Co. is not liable for indirect or consequential damages resulting from the use of delivered designs. Maximum liability shall not exceed the total project fee paid.

Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in NSW jurisdiction.

Amendments

Wera Design Co. reserves the right to amend these terms at any time. Updates will be posted on the website and will take immediate effect.

Acceptance of Terms

By engaging with Wera Design Co., you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
